Please take the time to read the following Terms and Conditions fully and carefully. By using and registering to buy Tickets via this site, You will be deemed to have agreed to and accepted all relevant Terms and Conditions.

These are the Terms and Conditions for [INSERT NAME AND LEGAL BITS, T/A etc.), acting as a provider of Tickets for [Papillon Promotions] and as an agent facilitating Ticket sales for the following: [List others if applicable]. We enter into this agreement with You on behalf of ourselves, and these third parties.

These Terms and Conditions relate to (part 1) Ticket purchases made by You from us, either in regards to Our Events or those being controlled by the aforementioned third parties and (part 2) your use of Our Website.

“Terms and Conditions” is, in this instance and all others throughout this site, used to describe the combination of these two parts. Where there is a conflict of interest, the latter (Website terms) will take precedence.

Within these Terms and Conditions, the words ‘We’ and ‘Us’ means [Papillon Promotions]  (registered as a company in England and Wales, number ______ registered office ______________)

Within these Terms and Conditions, the word “Event” means any individual Event or group of Events that are advertised within these Website, for which Tickets are available.

Within these Terms and Conditions, the phrase “Event Organiser” means either Papillon Promotions as the supplier, or any third party supplier(s) of Tickets for the Events, these third parties may include venues, performers, promoters, or Event organisers.

Within these Terms and Conditions, the words “Tickets” or “Bookings” means a paper Ticket or unique Booking reference which gives You the right to admission for the specified Event.

Within these Terms and Conditions, the word “Website” means the Website on which the Tickets are available, and on which We promote Events.

Within these Terms and Conditions, the word “You” means the individual purchasing Tickets using this Website.

Terms and Conditions for Ticket Purchase

Ticket sales

Rights to admission for Events promoted on this Website are sold in two forms, either in the form of an individual paper Ticket to be presented on entry to the Event, or in the form of a unique Booking reference that is delivered electronically via this Website.

Please note, in instances where Tickets are sold by a third party, We do not purchase Tickets, set prices, or make any decision with regards to seating positions and/or locations for the Event. In these instances, We collect the Ticket money on behalf of the third party, and supply them with the details of your Booking. Ownership of Tickets and right to grant entry stays with the third party Event Organiser and never passes to us.

In instances where Tickets are for Papillon Promotions Events, all Ticket prices are final unless otherwise specified, and You may not always have a choice of seating positions or locations. Please keep this information in mind when contacting Us with queries about Tickets or Ticket sales.

Your request to purchase Tickets using Our Booking process is made subject to the above Terms and Conditions, which You agree to when going through the purchasing process at this Website. Our acceptance, either on Our own behalf or on behalf of the third party Event Organiser, shall be deemed effective when your payment has been cleared and your purchase has been confirmed.

Bookings

In order to purchase Tickets through this Website, You must either set-up an account if You have not done so previously, or log-in to your previously existing account.

You must be aged 16 or over to purchase Tickets through this Website, however, where age restrictions are higher for a specific Event or venue, these must be complied with.

You may add Tickets to your basket at any time while logged-in to this Website, ensure that You check all purchases carefully before proceeding, because after proceeding, an offer had been made by You to purchase the selected Tickets.

Once this offer has been made to purchase the selected Tickets, subject to availability, We will check your payment details and, as long as all is correct, accept your offer and confirm your Booking with you, this will include displaying your unique Booking reference.

Upon this acceptance, We will take your payment using your chosen payment method. The face value of the Ticket will be taken using this method, along with any Booking fees that may be applicable. The Ticket price and any Booking fees will be clearly marked in your basket prior to confirming your purchase. We will then forward the face value of the Ticket to the Event Organiser where applicable, the Booking fee is a separate charge, this is made directly to Us for the facilitation of your Booking.

Your unique Booking reference will not be valid until We have processed and accepted your payment.

In cases where You require a VAT receipt and the Event You have purchased a Ticket facilitated by Us but provided by a third party, You must contact the Event Organiser to request a receipt.

Accessing the Event

Ensure that You keep your unique Booking reference and/or your paper Ticket safe, You may be refused entry to the Event without it.

Your unique Booking reference for each Booking will be subject to the following Terms and Conditions:

If You are the person who is making or has made the Booking, You must attend the Event yourself and must do so while accompanying any and all other persons for whom the Booking is made. Exceptions can only be made if your Booking, either wholly or in part, has been reallocated using Our reallocation system, more information on Our reallocation system can be found here. Some Events have age restrictions, You will not be able to reallocate your Ticket(s) into the name of an parson who is under the age required for attendance of the Event. Although We ensure to give all possible information on age restrictions, it is your responsibility to check the age restrictions of all third party Events.

Upon arrival at the Event You have booked, You or the person You have reallocated your Tickets to must provide your unique looking reference number, or paper Ticket, You may also be asked to provide your name, address, postcode, and photographic or signature identification, in the case of third party Events, it is your responsibility to find out in advance what is necessary in order for You to be granted admission for the Event You have booked. This information only needs to be provided by the person who has booked the Tickets, or the person who the Tickets have been reallocated to, although each person attending may have to provide proof of age if age restrictions or concessionary rates are in effect. It is your responsibility to ensure that all attendees within your party are fully aware of any relevant Terms and Conditions that relate to the Booking, Tickets, and Event.

The Reallocation System

For most Events, You may reallocate some or all of your Tickets to other people using Our reallocation system. This means that those other people can gain admission to the Event without You being with them. To reallocate Tickets after purchase, log in to My Account, use the My Tickets link to display your list of Tickets and then click on the reallocation button next to the Tickets You wish to reallocate. You will retain the original unique Booking reference and it will be valid only for the Tickets that You have not reallocated. A new unique Booking reference will be displayed for the Tickets You have reallocated. The people to whom You reallocate the Tickets must provide their unique Booking reference, identification and all other information detailed above in “Gaining admission to the Event”. You will continue to be bound by these Terms and Conditions regardless of the reallocation of some or all of your Tickets.

Reallocation may be unrestricted, restricted or unavailable.

We will use reasonable efforts to ensure that it is clearly stated during Booking if reallocation for a particular Event is restricted or unavailable.

Reallocation is usually unrestricted (available at any time up to midnight on the day before the Event, or up to midnight on Thursday for weekend Events).

For certain Events reallocation may be restricted (available up to two hours after the Booking), or unavailable.

Terms and Conditions of Venues

All Tickets issued for any Event are subject to all and any Rules and Regulations of the Event Organiser and of the Venue. Full details of Terms and Conditions are available on this Website when the Event is being run by Papillon Promotions, and by contacting the Event Organiser where the Event is being run by a third party.

You and all members of your party attended the Event must fully comply with the Rules and Regulations of both the Event Organiser and Venue, failure to do so may result in You or members of your party being refused admission or being ejected from the Event.

General Rules and Regulations are as follows:

This Website, the Event Organiser, and the Venue in which the Event is taken place accept no responsibility for any personal property you, or members of your party choose to take to an Event.

The Event Organiser may, at their discretion, choose to not allow pass-outs or re-admissions of any kind to their Event.

Official merchandise is, unless otherwise stated, only available within the venue in which the Event is taking place.

Where the Event Organiser is a third party, this Event Organiser has entered into an agreement with Us to honour the unique Booking references or paper Tickets and to consider both of these to have equal rights as each other or any other form of Booking that may be available to the same Event.

Where the Event Organiser is a third party, all details of the Events that We advertise and provide Tickets for are provided to Us on behalf of the third party Event Organiser. You are, therefore, strongly advised to check Event details with the Event Organiser, Venue, or both before attended the Event. The best efforts are always made by Us to ensure that all information is up to date and correct, but We cannot be held responsible for any errors in information about a third party Event.

We offer You the opportunity to buy Tickets from a number of Event Organisers through this Website. We exclude liability for any Tickets or other goods provided by Event Organisers or other third party suppliers to the fullest extent permitted by law. In no circumstance shall We be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with this agreement or purchases made through this Website save where such liability cannot be excluded by law.

Where the Event Organiser is a third party, any dispute or disagreement with regards to content or quality of the Event in question, or the actions of Event Organisers, Venue, or anybody else involved, is deemed to be solely between You and the Event Organiser.

No part of these Terms and Conditions should be deemed as limiting or excluding Our liability for personal injury, fraud, death, or any other issued caused by the negligence of Us, Our employees, or any other staff or directors associated with Us. 

Subject to the above Terms and Conditions Our maximum liability arising in connection with these Terms and Conditions and the Website shall be £1,000 per claim.

Refunds, Cancellations, and Rescheduling

Tickets purchased from Us cannot be refunded, aside from in the following circumstances:

An Event is cancelled.

An Event moved to another date for which You choose to not retain your Booking.

Details of an Event are deemed as having been significantly changed after an order is placed (e.g. a change of headline act or Venue.)

If any of the issues listed above occur, the face value of the Ticket may be refundable, all Booking fees are non-refundable.

Where the Event Organiser is a third party, We will contact You (using the details given in the My Account section) as soon as possible upon Us being informed of any cancellation or significant changes to an Event by the Event Organiser. We cannot be held liable if You do not receive this information due to not updating your contact details on Our Website. We also cannot be held liable if, due to the configuration of your e-mail account, an e-mail from Us detailing any changes is diverted to your spam or junk folders.

If an Event is cancelled, whether by Us or where the Event Organiser is a third party, We will automatically refund the face value of your Ticket without any need for You to claim it.

Where the Event Organiser is a third party, and We HAVE NOT been informed of an Event being cancelled, You must notify Us no more than 48 hours after the start time of the Event to claim a refund.

If We have been notified of significant changes to an Event or a change of date as set out above, and We have informed You of the change, You will be given the option of retaining your Booking, or claiming a full refund for the face value of the Ticket. If your choice is to receive a refund, You must let Us know as soon as is possible. If You do not notify Us before 4pm on the working day before the (original) date of the Event, You will be deemed as accepting the changes and will not be able to claim a refund. If We have notified You within the 48 hours prior to the Event, then You must instead notify Us as soon as possible.

If We HAVE NOT been notified of these changes by the Event Organiser, You must let Us know within 48 hours of the Event in order to be able to claim a full refund of the face value of your Ticket.

Where You have claimed a refund, the face value of the Ticket will be refunded to You using the same payment method that You used to make the original Booking. In instances where this is impossible or a payment fails, We will issue a cheque made payable to the name on the My Account section of this Website and sent to You via Royal Mail standard delivery.

Ticket transfers

By buying Tickets at This Website, You are deemed to have accepted the following:

Tickets are for You and your party only and You will make no attempt to transfer them outside of the reallocation system set out in these Terms and Conditions.

You will make no attempt to sell your Tickets on, including by utilising the reallocation system, this system is only for those who are buying on behalf of friends or children, not for the resale of Tickets.

If You make any attempt to transfer your Ticket in any way but through the reallocation system, or sell your Ticket in any way at all, your Ticket will be immediately invalidated and You will be refused entry for the Event at the Venue.

If We have any reason to suspect that You are attempting either of the above, We will immediately invalidate your Booking.

Papillon Promotions reserve the right to cancel any Tickets or Bookings if We have fair reason to suspect they have been acquired through fraudulent means.

Venue Rules and Regulations

Age restrictions may be in place at the Venue, as stated in these Terms and Conditions, although We will attempt to make You aware of any age restrictions, it is ultimately your responsibility to find out if your chosen Event (where the Event Organiser is a third party) has such restrictions in place.

Some Events will offer concessionary Tickets for people under a certain age, students, or the unemployed. If this is the case, and You buy a concessionary Ticket to such an Event, the holder of that Ticket must take suitable, valid identification or proof of circumstance. If You cannot do this, You may be charged the difference on the door of the Event, or refused entry entirely. We cannot refund your Ticket if You are refused entry due to not having proof of concessionary status.

Right to admission for an Event lies with the Event Organiser and the Event Venue. These entities may carry out security measures, or refuse entry if You are in possession of something that is deemed to break the rules of the Venue, pose a risk to health and safety, or raise any environmental concerns. It is your responsibility to find out in advance what is not accepted by an Event Organiser or Venue. If You are refused entry on these grounds, You will not be refunded for your Ticket. For certain Events where prompt arrival is necessitated, You may be refused entry if You are late, We will not provide a refund in these circumstances.

Items that may be prohibited from the Venue include electronic cigarettes, your own food and/or drink, pets or other animals, and laser pens. There may be other items outside of those listed previously that are also prohibited at certain venues. Ticket holders are advised to check the rules and regulations of the Venue and Event Organiser in advance of attending the Event.

Ticket availability

It may be the case that certain Events have a maximum Ticket allowance per buyer or restricted availability. This information will be indicated in the Event information on this Website during Booking. If You breach the restrictions for an Event, We reserve the right to refuse or cancel your order.

The Tickets available on this Website only reflects the remaining Tickets left of Our allocation, which is set out by the Event Organiser (where the Event Organiser is a third party), and does not reflect the amount of Tickets left for the Event, other box offices or outlets may carry more Tickets.

By using this Website, You will be deemed to have accepted the following Terms and Conditions. It is your responsibility to ensure that you, or anybody else who uses this Website via your log-in details, complies with all of these Terms and Conditions:

Access to this Website

We will always try to ensure that your access to this Website is uninterrupted at all times. However, access to this Website may be suspended or restricted at any time, access may also be terminated at any time.

On occasion, information on this Website may change, or be substituted without notice, We reserve the right to carry out these changes when they are deemed necessary.

We have no responsibility for the content of sites that have links available on this site.

All intellectual property (including trademarks and copyright) within the material present on this Website, along with design, text, graphics, and the arrangement thereof, and all software compilations, source codes and software belongs to, or is licensed to us, or the providers of the information. All rights are reserved. No material present on this Website may be reproduced, copied, or redistributed in any way without Our express written permission in advance. However, You may take (via print or download) a single copy for non-commercial, offline viewing.

Ownership of all copyright in terms of data You submit to this Website shall remain with You at all times. To the extent that is permitted by law that applies in these circumstances, We disclaim all warranties and all representations (implied or express) in terms of the accuracy of information found on this Website.

We exclude any liability (to the full extent of permissible law) for losses or claims that result from an inability to access this Website, or from and use of this Website or reliance on data transmitted while using it, due to the nature of electronic transmission of data on the Internet.

We shall, in no Event, be liable for any losses that are deemed indirect or consequential, or for loss of profit, data, opportunity, savings, goodwill, or reputation what may arise out of or in connection with these Terms and Conditions, Our Privacy Policy, or any use of this Website, with the exception of occasions where such liability cannot be excluded by law.

We do not give any guarantee or warranty to state that this Website is free from viruses or any other factors that may lead to harmful effect on technology, it is your responsibility to ensure reasonable safeguards are in place to avoid such circumstances.

Log-in details

Upon registration at this Website, You provide Us with your e-mail address and a chosen password which will allow You to gain access to restricted sections of Our Website. These details are unique to You and cannot be transferred to another party for any reason or in any circumstance.

We reserve the right to terminate your access to this Website at any time without notice.

We reserve the right, without notice, to terminate or cancel your Booking immediately and invalidate your Ticket so entry to an Event will no longer be granted.

General

If any provision within these Terms and Conditions is deemed to be invalid, unlawful, or in any way unenforceable, this provision will no longer stand, no other provision within these Terms and Conditions shall be affected as a result.

The Terms and Conditions on this Website may be changed at any time, in instances where this occurs, the modified Terms and Conditions will be posted on the Website. Any such changes will take effect three (3) days after the posting of the new Terms and Conditions on this Website.

We may modify terms of Ticket purchase at any time, in these cases We will provide You with the modified terms each and every time You make a Booking through this Website.

By making use of this Website, You will be deemed to have accepted the Terms and Conditions that are in place at the time of Booking. It is therefore advisable that You check these Terms and Conditions every time You make a Booking at this Website.

Any termination of agreement between Us will have no effect on disclaimers or exclusions that are listed within these Terms and Conditions.

All of these Terms and Conditions are governed by English Law and all involved parties submit to the jurisdiction of the English courts exclusively.

Neither party shall have any liability to the other in instances when neither party has control over an Event.

This agreement shall not be reassigned by one party to another party without the consent of the other party involved in this agreement. However, if there is a trade sale or reorganisation of Papillon Promotions, You will be deemed to have consented to the agreement still standing.

No part of this agreement is enforceable in any manner by anybody who is not party to is, except when Terms and Conditions directly relate (and are stated to directly relate) to the rights, rules, and regulations of third parties such as Event Organisers or Venues.
